Probate Attorney: ‘It’s a Standard Eviction’

“It’s a standard eviction,” said probate attorney, James Wagner.  Wagner was standing on the street watching the eviction process near the chest-high pile of Paul Dlugos belongings covering the tree lawn in front of 3155 W. 11th Street.  “It’s not so standard, obviously, but…”

According to Wagner, “Paul was the administrator of the estate, but the court removed him.  The court removed him because he didn’t post the bond and he lied to the court about who the heirs are — he filed an application saying there’s no heirs.  There’s five other heirs; family members.  They’re all family members.  Just go to the probate court docket, and search under Karol Dlugos.  It’s all in the docket.  It’s all in the docket.”

Wagner said Paul, his dog, and bird can live on W. 15th Street:  “Paul’s father had two properties, this one (3155 W. 11th Street) and the one on W. 15th (2623 W. 15th Street), and the famly’s allowed — said that he can move into the property on W. 15th.  That property is in his father’s name.  His father died without a will, so it all passes to the family members.  He died in December of 2014, I think.”

Wagner maintains the Dlugos’ relatives are simply trying to sell the house to cover costs related to the estate.  He said, “This process has been going on for two months, in terms of the eviction.  Even before that:  ‘Paul, you’re going to have to move.’  ‘I’m not moving.’  ‘Paul, we’re going to have to file an eviction.’  ‘Well, you do what you want to do.’  ‘Okay.’  He’s just very stubborn — that’s the way he is, and that’s fair enough, but this is what it comes down to:  the house has to be sold to clear up the estate.”
